New State Standards in the sphere of industrial property

In accordance with the state standardization plan the following new standards of Ukraine (DSTUs) were drafted and took effect on the territory of Ukraine as from January 1, 1998, pursuant to Order by the State Committee for Standardization No. 327 of June 6, 1997:
DSTU 3574-97 “A patent record. Main provisions. Procedure for its drawing up and completion”
DSTU 3575-97 “Patent research. Main provisions and procedure for carrying out thereof”.
DSTU 3575-97 replaces and overrides the former SU Standard GOST 15.011-82 “System for development and implementation of R&D results in production. Procedure for carrying out patent research”. It governs the procedure for carrying out patent research in order to investigate and determine patentability of a subject of economic activity, the situation as regards exploitation of industrial property rights and to bring to light probable infringement of rights of holders of valid titles of protection or applicants.
DSTU 3574-97 replaces and overrides the former SU Standard GOST 15.012-82 “System for development and implementation of R&D results in production. Patent record”. It governs the procedure of drawing up and completion of a patent record, an official information document which attests to the status of a subject of economic activity (as a commodity) in respect of infringement of industrial property rights of holders of valid titles of protection or applicants.
The Standards have been drawn up in compliance with the current Ukrainian legislation in the sphere of protection of industrial property rights. The requirements of the Standards are mandatory for all legal entities operating in the territory of Ukraine whose activities are fully or partially funded from the state budget. The Standards also serve as recommendations for all other legal entities operating in Ukraine.
