A request for grant of a patent must be submitted in the required form and contain all prescribed particulars.
A request must contain a statement as to which industrial property right (an invention or a utility model patent) is sought.
Where a patent for invention is sought, the applicant must further specify the kind of patent: a patent with the term of 20 years granted after the substantive examination or a patent with the term of 5 years granted under the liability of the applicant, without the substantive examination.
A request must state the particulars of the applicant or applicants: the full name of a person or the full name of a legal entity and their address.
The full name of a foreign applicant, whether a natural person or a legal entity, must be rendered by transliteration with the letters of the Ukrainian alphabet. The transliteration must be followed by the full name of the applicant in the original language given in parentheses. Besides, the particulars of the place of residence or permanent stay of the applicant must be given in the original language, wherever possible.
If the applicant has grounds for establishing an earlier priority date, an indication to this effect must be included in the request.
Completion of the last column of the request form (“Signatures”) is obligatory unless all the inventors act as the applicants.
Where only one or some of the inventors are at the same time the applicants, their signatures in the last column are mandatory. If a legal entity acts as the applicant, a signature of its head is required, followed by his surname with the initials, his job title, and authenticated by a stamp.
